FG Legitimizing Illegality With Judiciary – EX NBA VP
By Olamide Fadoju
Ex-Vice-President, Nigeria Bar Association (NBA), Barrister Monday Ubani has accused the Federal Government of using the judiciary to “legitimize illegality”.
Ubani made these accusations in an interview with Wemimo Adewuni and Sheriff Quadri on 99.3 Nigeria Info FM programme, Morning Crossfire.
Reacting to the court granting the DSS the right to further hold #RevolutionNow convener, Omoyele Sowore for 45 days without charge, Ubani insists that such judgements make it difficult to seek justice for detainees.
The Ex-NBA VP also addressed the cases of detainees who have been held by the Federal Government (FG) for being a danger to national interest saying that while the FG can keep such people, only the court can grant them permission to do so.
Ubani further stated that once the Judiciary has considered all evidences against an individual alleged to have committed a crime against the State and insist that the detainee be released on bail, the Federal Government has “no right" to ask that national interest be considered. According to him “When there is a clash between national interest and personal interest the truth of the matter is that national interest or security supersedes.”
“So, if the same judiciary now tells you that after assessing your own facts and after assessing the individual fact, that they feel that this individual right should be respected, then you cannot stay in your house as an Executive to now interprete and begin to cite Asari Dokubo’s case,” he said.
