COURT ORDERS INEC TO ISSUE CERTIFICATE OF RETURN TO OKOROCHA

The Independent and National Electoral Commission (INEC) has been ordered by  a Federal High Court in Abuja to issue a certificate of return to Rochas Okorocha, the former Imo state governor.

 

INEC, according to Justice Okon Abang had no reason not to issue Okorocha a certificate of return having been declared the winner at the February 23 senatorial election for the Imo West Senatorial District by the Returning Officer.

 

Justice Abang overruled the submission of Jones Onyeriri and Osita Izunaso, candidates of the PDP and APGA respectively, which said that the matter be taken to the election petitions tribunal since it had become a post-election matter which stripped the court of jurisdiction under section 285, opf the 1999 Constitution.

 

INEC had said that its refusal to hand Okorocha a certificate of return was owing to the fact that the returning officer for Imo West Senatorial District had stated that he was compelled to declare Okorocha winner.
