The Supreme Court has thrown out the suit filed by the All Progressives Congress and its candidate, Ovie Omo-Agege against the election of the Delta State governor, Sheriff Oborevwori.

In its judgment, the court said the appeal lacked merit and the appellant was unable to prove its complaints.

Omo-Agege and the APC had prayed the court to nullify the election, alleging the vote was not conducted in substantial compliance with the provisions of the Electoral Act.

But the presiding judge, Justice John Inyang Okoro, held that the former Deputy Senate President did not establish that the election was invalid for corrupt malpractices.

Justice Okoro said that none of the allegations against the March 18, 2023 election was established as required by law.

He also rejected Omo-Agege's claim that the results of the governorship election were not properly recorded in some polling units and the allegations that the forms that contained some of the recorded results did not have serial numbers.

Oborevwori of the PDP got 360,234 votes in the 2023 Governorship Election in Delta State, while Omo-Agege of the APC polled 240,229 votes.
