The Court of Appeal in Abuja on Friday upheld the ruling of the National Industrial Court of Nigeria which ordered the Academic Staff Union of Universities (ASUU) to call off its strike.
The three-member panel of the appellate court led by Justice Hamma Barka however granted ASUU’s permission to appeal the ruling of the industrial court but ruled that it must first resume work to be allowed to file the appeal.
It said the permission it gave to the union to appeal against the interlocutory injunction of the National Industrial Court “will be automatically vacated” if ASUU fails to get back to class.
The court handed a seven-day ultimatum to the striking lecturers within which to file its notice of appeal against the order of the National Industrial Court.
