Dave Umahi: Why Votes Belong to Candidate Not Party - SAN

Senior Advocate of Nigeria, Yemi Candide-Johnson, believes it is not right for a court to sack an elected official from office for decamping to another party.

Candide-Johnson said this on Daily Digest with Jimi Disu while reacting to a recent court judgement concerning Ebonyi State governor, Dave Umahi.

Judge Inyang Ekwo of the Federal High Court in Abuja, in his judgement, ruled that the total number of votes secured during the governorship election belonged to the PDP and therefore, by decamping to the APC, Umahi lost those votes and should no longer be governor.

But, in his reaction, Candide-Johnson said it is important to understand that a party cannot be a candidate in an election, hence an individual is selected as the flag bearer.

He insists that with this, it is not right for a candidate, who has gotten the mandate of the people, to be denied his position because he has a problem with his party.

He recommends other ways a decamping party member can be punished.
