Supreme Court Overturns Nnamdi Kanu’s Acquittal

The Supreme Court has overturned the verdict of the Appeal Court which dismissed the charges against Nnamdi Kanu.

Ruling in favour of the Federal Government, The Apex Court held that Kanu must face trial at the Federal High Court.

Presiding judge, Justice Emmanuel Agim, disagreed with the Court of Appeal’s judgement that Kanu could not be tried again due to the illegality perpetrated against him by the Federal Government, following the invasion of his home.

The court held that the Federal Government’s unlawfully arrest of Kanu from Kenya does not stop the Court from proceeding with trial.

According to Justice Lawal there was no Nigerian law used to justify suit seeking Kanu’s release on the grounds of unlawful abduction from Kenya.

The Court maintained that the current recourse for such an action is for Kanu to file a civil matter against the act instead of stripping the court of its jurisdiction.
