The presidential candidate of the Labour Party, Peter Obi, has filed 51 grounds of appeal at the Supreme Court to nullify the judgment of the Presidential Election Petition Tribunal (PEPT) which upheld Bola Tinubu’s presidential election victory.
In the appeal filed on Tuesday, Obi described the tribunal’s verdict as erroneous.
His lead counsel, Dr. Livy Uzoukwu (SAN) argues that the tribunal justices were wrong in concluding that the petitioners did not specify the polling units where irregularities and malpractices occurred or the number of votes they alleged were suppressed, deflated, or inflated.
Peter Obi and the LP hold that they were able to prove over-voting in polling units in 13 states.
They also say the tribunal “unlawfully discountenanced” the proof which they itemized in the “forensic report produced/tendered by the appellants.”
In addition, Obi’s team alleges that the justices erred in ruling that it was the appellants’ duty to prove that INEC failed to comply with the mandatory requirements of section 73(2) of the Electoral Act in the conduct of the 2023 presidential election.
His counsel says INEC refused to produce the election materials Obi’s team applied for at the PEPT “despite the service of the subpoenas” on the electoral umpire.
The Labour Party presidential candidate’s appeal to the Supreme Court was filed the same day as that of the candidate of the People’s Democratic Party, Abubakar Atiku.
Atiku also wants the Supreme Court to nullify the judgment of the Presidential Election Petition Tribunal.
