Absence of Results on the IReV Not Enough Ground to Nullify Election - Supreme Court

The Supreme Court has held that the absence of election results on the INEC Result Viewing Portal (IReV) is not a ground to nullify the February 2023 presidential election. 

Justice John Okoro while reading out the ruling of the apex court on Thursday, noted that the petitioner seeking to nullify the election for noncompliance must not only prove how the non-compliance affected the outcome election but must be ready to provide sufficient evidence.

Counsels to Peter Obi of the Labour Party (LP) and Atiku Abubakar of the Peoples Democratic Party (PDP), had challenged the emergence of Bola Tinubu as the winner of the presidential election on the failure of INEC to transmit all results to the IREV before declaration of winner.

Justice Okoro added that the Electoral Act empowers the Independent National Electoral Commission (INEC) to determine what method it considers best during an election.

According to him, the appellant has not produced certified true copies of evidence to support their appeals.
